Foreigners 24/11/2025
Hiring foreign employees brings expertise and international experience to businesses in Vietnam. However, employers must strictly comply with the legal requirements regarding work permits to avoid administrative penalties and ensure a smooth onboarding process. Most foreigners working in Vietnam for more than 30 days or under a labor contract of over 3 months must obtain a Work Permit. Common categories requiring a permit include:
Experts, managers, and technical workers recruited by Vietnamese enterprises.
Employees transferred internally within a foreign-invested company.
Foreigners working under labor contracts, service contracts, or project assignments.
Certain individuals may be exempt from a Work Permit, but they still need to obtain a written confirmation of exemption from the competent authorities.
Work Permit Procedures for Foreign Employees in Vietnam
Step 1 – Approval of foreign labor use:
The employer must file a request explaining the need to hire foreign workers.
Step 2 – Prepare required documents:
Passport, health certificate, criminal record, professional qualifications, work experience confirmation, and other documents depending on the job position.
Step 3 – Submit the Work Permit application:
Documents are filed with the Department of Labor, Invalids and Social Affairs (DoLISA).
Step 4 – Receive the Work Permit and finalize employment:
Once issued, the Work Permit allows the foreign employee to sign a labor contract and fulfill employment procedures such as tax registration and social insurance (if applicable).
Processing time is typically 20–30 working days, depending on the completeness and legality of the documents.
